Abstract
Open access to official and authenticated legal information in Vietnam
Sources of open access to official and authenticated legal information are an essential component to the legal information system of any country. Not surprisingly, it is more important in the context of Vietnam is promoting the implementation of the strategy of judicial reform to the year of 2020 aims to build of the state rule of law and the e-government. In recent years, thanks to the application digital technology and the internet on legal information, the access to legislation, treaties and agreements, jurisprudence as well as law journal is easier, more convenient never than before. The number of free, open access to legal information sources has increased dramatically. Such of legal information sources are published not only by the state’s agencies such as the National Assembly, Government, Government’s Agencies, Supreme People’s Court, Supreme People’s Prosecutor but also by universities and research institutions. This article focuses on the current situation of open access to official and authenticated legal information in Vietnam. It reviews the development process of open access to official and authenticated legal information over the past decade. From the standpoint of law and technology, it analysis, evaluates the achievement, points out the challenges of open access to legal information. The recommended policies and solutions to the improvement the open access to official and authenticated legal information in national and international level are put forth..Acceso Abierto a la Información Legal Oficial y Autenticada en Vietnam
Las fuentes para el acceso abierto a la información legal oficial y autenticada constituyen un componente esencial para el sistema de información legal de cualquier país. En consecuencia, en el contexto de Vietnam es más importante promover la implementación de la estrategia de reforma judicial para el año 2020 que apunta a construir un estado de derecho y un gobierno digital (e-gobierno). En los últimos años, gracias a internet y la aplicación de la tecnología digital con respecto a la información legal, el acceso a la legislación, a los tratados y acuerdos, a la jurisprudencia, y a las publicaciones jurídicas es mucho más fácil y conveniente que en el pasado. La cantidad de fuentes de información legal de acceso abierto y gratuito ha aumentado considerablemente. Dichas fuentes de información legal son publicadas por la Asamblea Nacional, el Gobierno, los Organismos Gubernamentales, la Corte Suprema Popular, la Fiscalía Popular Suprema, y también por las universidades e instituciones de investigación. Este artículo se centra en la situación actual del acceso abierto a la información legal oficial y autenticada de Vietnam. Realiza una revisión del proceso de desarrollo del acceso abierto a la información legal oficial y autenticada durante la última década. Desde el punto de vista del derecho y la tecnología, analiza, evalúa los logros, y señala los desafíos del acceso abierto a la información legal.
