Abstract
Copyright worldwide legislation affect the users' right to free access to information, for which we collect specialize opinions on "Limitations and Exceptions" driven by the IFLA Latin America and the Caribbean (LAC) Section. A regional survey was applied to diagnose the impact of legislation on Copyright and Related Rights and the Marrakech Treaty in Peruvian libraries, gathering difficulties, limitations and experiences that provide proposals for exceptions to the right.
The sample of 112 individuals representing librarians and library assistants, shows a high degree of unknowledge and ambiguity about copyright law, provision of services with different works, including paper print and digital environments. This isan evidence to promote an awareness campaign and training for librarians and professionals from many areas of knowledge, including policy makers, to bring legislation considering limitations and exceptions for libraries and archives. The Peruvian LibraryAssociation must actively participate in the formulation.

La legislación de Derecho de Autor a nivel mundial está afectando el derecho de los usuarios al libre acceso a la información, por lo cual se recogen diversas “Limitaciones y Excepciones” impulsadas por la Sección IFLA de Latino América y el Caribe (LAC). Se aplicó una encuesta regional para diagnosticar el impacto de la legislación sobre Derechos de Autor y Derechos Conexos y el Tratado de Marrakech en bibliotecas peruanas, recogiendo dificultades, limitaciones y experiencias que aporten propuestas de excepciones al derecho. La muestra de 112 individuos representa a bibliotecólogos y responsables de bibliotecas, quienes revelan un alto grado de desconocimiento y ambigüedad sobre la legislación de derechos de autor, la oferta de servicios con obras diversas, incluyendo entornos impresos y digitales. Se evidencia la necesidad de impulsar una campaña de sensibilización y capacitación para bibliotecólogos y profesionales de otras áreas del conocimiento, incluyendo formuladores de políticas, para adecuar la legislación, considerando excepciones y limitaciones en favor de bibliotecas y archivos.
