Abstract

The present research was made in order to know the label of knowledge of Guatemalan librarians about copyright laws, copyright exceptions and limitations for libraries. The present questionnaire was answered by people currently working in public and university libraries and documentation centers; most of them refuse to give some services in order to avoid some kind of sanction because of the copyright law. The Legal Deposit Legislation doesn´t fully complies with sanctions to authors that not meet the terms in delivering their works at the National Library and San Carlos University Library. Besides, there are some institutions that don´t have the appropriate conditions to preserve this kind of materials and also don´t have borrowing and circulation services. For that reason, many libraries don´t have Guatemalan authors in print or in digital format. Marrakech Treaty is not known at all by the community of librarians, who supports services for people with disabilities. On the other hand, small-budget is available to produce materials for this kind of services and for this segment of the population. At large, there is a need to socialize the copyright exceptions and limitations statements that will provide libraries the support for better services and will help them by the knowledge to preserve materials in their collections to reproduce them in digital format in order to have a better access to information. In summary, there is a need also, of better laws to import resources directly without limitations, to support libraries by the understanding of best and more services and will help to impulse a collection development.

Guatemala: situación de las bibliotecas en relación con el derecho del autor

El presente estudio demuestra el grado de desconocimiento en las Bibliotecas guatemaltecas respecto a las leyes de derecho de autor y las excepciones para bibliotecas.El cuestionario respondido por representativos de las diferentes bibliotecas, nacional, públicas, escolares, universitarias y centros de documentación, señala que la mayor parte de las bibliotecas no dan servicios para evitar ser sancionados. El Depósito legal no se cumple a cabalidad ya que la legislación al respecto no es clara, ejerce poca presión y sanciones a los autores que no cumplen con la entrega de sus obras a las Bibliotecas Nacional y Central de la Universidad de San Carlos de Guatemala. Además en dicha ley se enumeran como depositarias, instituciones que no poseen ni el servicio ni la disponibilidad para resguardar las obras o darlas en consulta. Esto hace que las Bibliotecas no cuenten con toda la producción de los autores guatemaltecos ya sea en formato impreso o digital que existe a la fecha. Son muy pocas Bibliotecas las que dan servicios a usuarios con discapacidad, no tienen posibilidades de reproducir copias de obras para dar estos servicios, y la mayoría de bibliotecas no conoce el Tratado de Marrakech. En general en Guatemala se necesita socializar más todo lo concerniente al Derecho de Autor y a las excepciones que respaldan a las bibliotecas para ofrecer mejores servicios, resguardar las obras que se encuentran en sus colecciones y reproducir en formatos digitales para mejor acceso a la información. Que la legislación permita que las bibliotecas adquieran obras fuera del país facilitando que los trámites no sean tan engorrosos, ayudará a mejorar los servicios e impulsar un mejor desarrollo de las colecciones.
