Abstract

In this research work, we tried to make an analysis on the knowledge level and application that Librarians, archivists and information managers have on Copyrights and related rights, and also about the fulfillment of it. In addition, we also hand over exceptions that serve as support for Libraries to ease the information they require. To make this research possible, we gathered to Directors of Public Libraries, School, Universities, Archives and Documentation Centers and specialists on the subject of Copyright considering them as a representative sample,due to their characteristics and functions of services that each one of them offer. While we still have no evident presence of cases that have violated the Copyright law, it is clear that there has been cases that have fallen between the illegal subject; supporting those cases on policies and internal guidelines of each one of the institutions, but considering that at the same time there is no entity that may keep and avoid this type of scenarios. At this time, the National Office of Copyrights concludes that these cases are hard to control. Disagreements on how the law is handled have been identified as well, such is the case of having a clear concept of the information units related to preserving without taking the dynamic into account, which carries the services that segregate from the quality of the same. Another relevant aspect is the lack of promotion and divulgation of the law in a more widespread manner, however, this knowledge is available due to the same pro-activeness of the people that are interested in the subject and develop information services for libraries.

Nicaragua: Situación de las bibliotecas en relación con el derecho de autor

En este trabajo investigativo tratamos de realizar un análisis sobre el nivel de conocimiento y aplicación que sobre la Ley de Derechos de Autor y Derechos Conexos tienen los bibliotecarios, gestores de información y archivistas nicaragüenses y también sobre el cumplimiento que hacen de la misma. En ésta se manifiestan excepciones que sirven de gran apoyo a las bibliotecas para facilitar la información que les solicitan. Para la realización de este trabajo, convocamos a Directores de Bibliotecas Públicas, Escolares, Universitarias, Archivos y Centros de Documentación, así como Especialistas en el tema de Derechos de Autor considerándolos como una muestrarepresentativa, por las características y funciones de los servicios de información que ofrecen cada uno de ellos. Si bien es cierto aún no se dan casos que implique que alguna unidad de información haya infringido la ley, es obvio que se ha caído en algunos momentos en asuntos ilegales; soportando tales situaciones en políticas y reglamentos internos de cada una de las instituciones, pero que también no hay un ente que los evite y en consecuencia los controle. Por el momento la Oficina Nacional de Derechos de Autor y Derechos Conexos aduce que es difícil controlar estos casos. También se observan algunos desacuerdos en cuestiones de concepto que maneja la ley, como el caso de conceptualizar las unidades de información como unidades de conservación y preservación sin tomar en cuenta la dinámica que conlleva los servicios que de ella se desprende para la calidad de los mismos. Otro aspecto relevante es la falta de promoción y promulgación de la ley de forma amplia, más sin embargo, existe conocimiento de la misma por iniciativa propia de las personas interesadas en el tema y que desarrollan servicios de información en las bibliotecas.
